Johns Creek council approves one subdivision rezoning, defers another

A rezoning request for a 12-unit single-family detached subdivision at Abbotts Bridge and Byers roads got the green light from Johns Creek councilmembers Monday, while a rezoning case for a four-unit subdivision on Findley Road was sent back to the city’s planning commission.

Mayor Mike Bodker and councilmembers approved 3.2 acres of land at Abbotts Bridge and Byers roads to be rezoned from the agricultural district to the townhouse residential district. The vote was 6-0 with Councilwoman Kelly Stewart absent from the meeting.

Justin Kirouac, the city’s planning and zoning administrator, said the new zoning is not just for townhomes but allows single-family detached homes as well.

Among the multiple conditions tacked on to the rezoning approval were provisions to reduce the distance between buildings from 14 feet to 10 feet and to allow for exterior building materials other than masonry.

The smaller side setbacks are similar to other subdivisions in the area, Kirouac said. Mike Smith, the applicant of the rezoning request, said the flexibility in building materials would allow for a diversity of housing styles as opposed to one monotonous look for the subdivision.

After receiving a new version Monday of plans for the proposed four-unit subdivision on Findley Road, Bodker and councilmembers voted 5-1 to send the project back to the planning commission for reconsideration, with Councilwoman Karen Richardson voting in opposition.

Councilman Ivan Figueroa said applicant Richard Smith’s last-minute plans had not been given the chance to be vetted by city staff or the planning commission. Figueroa initially proposed denying the application altogether, but his motion failed.

Richardson then suggested approving the application subject to the developer building only two houses on the 1.45-acre plot as opposed to four. The concern for fewer homes in the subdivision was brought up by neighbor Miles Moody. However, Richardson’s motion did not garner majority support of the council.

The planning commission will consider the applicant’s modified plans and will hold another public hearing for the project at its Aug. 6 meeting.
